Family Law and its Short History
At my age, marriage is not far from mind. There are days I find myself looking at wedding sites, engagement rings, and pictures of families I don’t even know. However, there are also times that I feel I am not ready to have a family of my own yet. So what I did was to read about several laws pertaining to the family.
Family law and its developments are greatly inspired by the Bible. Also, before the Family law was developed, the Mosaic law stated that a man is not allowed to marry the following personas: sister; mother, stepdaughter; half-sister; and the granddaughter in law.
I also found out that the Canon Law or the Catholic Church used to describe divorce as only separation from the bed and board. This apparently means that they are still husband and wife. It was also said that the man was still expected to provide for his wife even if they were divorced. This is called divorce a mensa et thoro. Later on, due to the conflict between King Henry VIII and the Church, divorce eventually meant that the ties between husband and wife would be severed.
I guess divorce in the developed family law is also inspired by King Henry VIII. I am not entirely sure if I am in favor of divorce. I mean, I can’t imagine living with someone I do not love or respect anymore. On the other hand, I wonder if couples would give it more effort and try harder to keep the relationship work if divorce was never included in the family law.
